根据《中华人民共和国合同法》及其他相关法律的规定,甲、乙双方在平等、自愿、公平和诚实信用的基础上,经协商一致,就乙方承租甲方房屋事宜,订立本合同,以资共同遵守。
This Contract is entered into by and between Party A and Party B with respect to Party B intending to lease the house of Party A in accordance with the Contract Law of the People’s Republic of China and other relevant laws and on the basis of equality, impartiality and good faith.
一、 出租房屋
1-1 甲方出租给乙方的房屋为座于落XXXX(以下简称“该物业”)附件一载明位置之房屋(以下简称“该房屋”)。
1-2 甲方作为该房屋权利人,将该房屋出租给乙方,与乙方建立租赁关系。
1-3 该房屋建筑面积详见附件一。双方确认,该房屋建筑面积最终以房地产行政主管部门认可的测绘机构确认的该房屋实测建筑面积为准。租金、物业管理费、租赁保证金、装修管理费、装修管理押金、水费、电费等公用事业费押金及其他费用均以实测建筑面积为计算依据。
1-4 该房屋平面图详见附件三,具体租赁部位见平面图中红色标注部分,该红色标注只作位置确定及方便鉴别之用。
1-5 甲、乙双方确认附件四作为甲方向乙方交付该房屋的标准。
二、租赁用途
2-1 乙方承租该房屋仅能按照附件一载明的用途。乙方应遵守国家和上海市有关房屋使用和物业管理的规定,以及该房屋物业管理相关规定。
2-2 在租赁期内,未征得甲方书面同意及未取得有关部门审核批准(如改变后的经营范围须审核批准的),乙方均不得改变上述约定的用途。
2-3 在租赁期内,乙方不得擅自改变该房屋用途、商业名称。
1-1 The house to be leased by Party A to Party B is located in XXXX (hereinafter referred to as “this Property”), the location of which is indicated in Exhibit I (“the House”).
1-2 Party A, being the right holder of the House, will lease the House to Party B, and establish lease relationship with the latter.
1-3 The building area of the House is detailed in Exhibit I. Both Parties acknowledge, the building area of the House is finally subject to the measured building area confirmed by the surveying institution recognized by the competent real estate authority. Calculation of the rental, property management fee, premium for lease, decoration management fee, decoration management deposit, deposits for utilities expenses like water fee, electricity fee and other fees are all based on the measured building area.
1-4 The house plan is detailed in Exhibit III hereof. Specific lease position is indicated in red in the plan, which is used only for deciding the position and facilitating identification.
1-5 Party A and Party B acknowledge Exhibit IV will serve as the criteria by which Party A delivers the House to Party B.
2-1 Party B leases the House for the purpose stated in Exhibit I only. Party B shall comply with the regulations of the State and Shanghai in relation to house use and property management, and the relevant regulations on the property management of the House.
2-2 During lease period, Party B shall not change the purpose agreed above without the written consent of Party A and the approval of relevant department (e.g., the changed business scope that needs examination and approval).
2-3 During lease period, Party B shall not change the purpose and business name of the House without permission.
