4．租赁车在租赁期间， 发生事故、应协助乙方处理事故。
5．租赁期间对车辆使用情况实施监督。
本条款根据《中华入民共和国合同法》、《北京市汽车粗赁管理办法》等有关法律、法规、规章制订。
第一条出租方的权利
1、拥有租赁车辆所有权。|
2、依合同向承租方计收租金及约定费用。
第二条出租方的义务
1、向承租方交付技术状况为一级标准、设备齐全的租赁车辆， 以及租赁车辆行驶所需的有效证件。
2、交接租赁车辆时如实提供车辆状况信息。
3、免费提供租赁车辆保养以及承租方按操作规程使用租赁车辆出现的故障维修服务。
4、提供本市行政区域内故障、事故的24小时救援服务。
5、承担不低于80%的因交通事故或盗抢造成的租赁车辆现值损失。
6、承担保险公司相关条款范围内的第三者责任险。
7、对所获得的承租方信息负有保密义务。
第三条承租方的权利
1、按合同的约定拥有租赁车辆使用权。
2、有权获知保证安全驾驶所需的车辆技术状况及性能信息。
3、有权获得出租方为fe障租赁车辆使用功能所提供的相应服条。
第四条承租方的义务
1、如实向扭租方提供驾驶本、身份证、户口本、营业执照 等身份证明资料。
2、按合同约定交纳租金及其他费用。
3、按车辆性能、操作规程及相关法律、法规的规定使用租 赁车辆。
4、妥善保管租赁车辆，维持车辆原状。未经出租方允许， 不得擅自修理车辆，不得擅自改装、更换、增设他物。
5、协助出租方按规定期限对租赁车辆进行车检及维修保养。
6、承担不髙于20%的因交通事故或盗抢造成的租赁车辆现值损失；承担因交通事故引发的其他责任。
7、保护出租方车辆所有权不受侵犯。不得转卖、抵押、质 押、典当、转借、转租租赁车辆。
8、租赁车辆发生交通事故、被盗抢时，应立即向公安、交 管等部门报案并在12小时内通知出租方，并协助出租方办理相 鮮续。
9、保证租赁车辆为合同登记的驾驶员驾驶。在租赁期内， 如承租方登记的信息发生变化，应及时通知出租方。
10、租赁期满，应按时返还租赁车辆及有效证件。
These Articles are developed pursuant to the Contract Law of the People’s Republic of China, Regulations on the Management of Automobile Lease in Beijing as well as other related laws, rules and regulations.
Article 1: Rights of the Leasor
1. Has the ownership of the Leased Vehicle.
2. Collects rentals and agreed fees from the Leasee pursuant to the Contract.
Article 2: Obligations of the Leasor
1. Delivers the Leased Vehicle in first-grade technical conditions with complete set of facilities, together with effective certificates required for the running of the Leased Vehicle to the Leasee.
2. Offers the true information of the Leased Vehicle’s status when handing over the Leased Vehicle.
3. Offers free maintenance service for the Leased Vehicle as well as repair service in the event of any failure of the Leased Vehicle occurring in the use of the Leased Vehicle by the Leasee in accordance with the applicable operating rules.
4. Offers 24-hour rescue service for any failure or accident in the territory of Beijing.
5. Bears not less than eighty percent (80%) losses at present value of the Leased Vehicle caused by traffic accident or theft and robbery.
6. Bears the third-party liability risks within the range of relevant provisions of the insurance company.
7. Is obligated to keep confidential the Leasee’s information obtained.
Article 3: Rights of the Leasee
1. Has the right to use the Leased Vehicle as agreed in the Contract .
2. Has the right to know any technical status and performance information of the Leased Vehicle required ensuring safe running.
3. Has the right to receive relevant services from the Leasor to ensure the usable functions of the Leased Vehicle.
Article 4: Obligations of the Leasee
1. Provides the Leasor with true identification information such as driver’s license, ID card, household registration book, business license, etc.
2. Pays rentals and other fees as agreed in the Contract.
3. Uses the Leased Vehicle in accordance with the Leased Vehicle’s performance, operating rules as well as provisions of relevant laws and regulations applicable.
4. Keeps the Leased Vehicle properly, maintains its present status. Without the permit of the Leasor, the Leasee shall not repair and refit the Leased Vehicle, replace and/or add any other parts.
5. Assists the Leasor in inspecting and maintaining the Leased Vehicle in the period stipulated.
6. Bears not more than twenty percent (20%) losses at present value of the Leased Vehicle caused by traffic accident or theft and robbery; assumes other responsibilities caused by traffic accident.
7. Prevents the ownership of the Leased Vehicle from infringement. Must not re-sell, mortgage, pledge, re-lend, and sublease the Leased Vehicle.
8. In the event of any traffic accident, theft and/or robbery against the Leased Vehicle, reports to the public security authority, traffic administration authority etc, within twelve (12)12 hours, notifies the Leasor and assists the Leasor in executing relevant formalities.
9. Ensures the Leased Vehicle to be driven by the driver registered in the Contract. Within the term of lease, the Leasee shall inform the Leasor in a timely manner any change in the Leasee’s information registered.
10. Upon expiration of the lease, the Leasee shall return the Leased Vehicle and effective certificates on schedule.
